By visiting the website or using the services in any manner, you accept and approve to be bound by and a party to the terms and conditions of this agreement to the exclusion of all other terms.
If you, the user, do not unconditionally agree to all terms and conditions put forth in this agreement, you forfeit the right to utilize the website or any of its services. Use of PTT Outdoor Adventure Services is expressly conditioned upon your assent to all the terms and conditions of this agreement, to the exclusion of all other terms.
1. Access and Use of the Service
The PTT Outdoor Adventures website, including its domain name and subdomains, its features, content or application services; including but not limited to mobile application services offered periodically by PTT Outdoor Adventures in connection therewith the Website are owned and operated by PTT Outdoor (MY) Sdn. Bhd.
PTT Outdoor Adventures reserves the right, at our sole discretion, to alter, discontinue or suspend the Services at any time; including features, database or Content of the Site. PTT Outdoor Adventures reserves the right to restrict your access to parts or the totality of the Services without warning or liability. PTT Outdoor Adventures also holds the right, in its sole discretion, to alter this Agreement at any time. However, a notice will be posted on the Website, or sent via email to users. In that case, you will be held responsible for reviewing and familiarizing yourself with those changes. Your use of the Services, thereafter, constitutes your acceptance of the terms and conditions of the modified Agreement.
You approve and verify that you are legally permitted to use and access the Services offered and hold full responsibility for the use and access of the Services. Do note that this Agreement is null when and where prohibited by the law; whereby the right to access the Services will be revoked in such jurisdictions.
2. Website & Services Content
All materials displayed or conducted on the Services including but not limited to, text, articles, graphics, photographs, illustrations or images; hereby known as “Content”, and which includes User Submissions (as defined below) are protected by copyright of PTT Outdoor Adventures. You are required to abide by all copyright notices, information, restrictions and trademark rules incorporated in any Content accessed via Services.
You will not use, reproduce or copy, modify, translate, transmit, publish, distribute, upload, display, license, perform, broadcast, sell or otherwise exploit any Content, third-party submissions or proprietary rights not owned by you. You may only do so under the express prior written consent of respective owners and without violating any third-party rights.
Any personally identifiable information will only be shared in accordance and within the ambit of PTT Outdoor Adventures’ Privacy Policy in effect at that time. All content and information shared publicly or privately transmitted via Services is the sole responsibility of the person responsible for sharing said contents and PTT Outdoor Adventures will not be liable for omissions or errors in any of these contents.
Again, PTT Outdoor Adventures will not be held accountable for any Content, including, but not limited to, errors or omissions, incurred losses or damage of any kind in relation to the use or exposure of Content posted, accessed, shared or transmitted via email or other medium made available via the Services under whatever circumstances.
Additionally, the authenticity of information which Merchants or users provide is not guaranteed. By using and accessing the Website, you acknowledge and agree that you do so at your own risk, holding sole responsibility for any loss or damage to any party resulting therefrom.
3. Privacy Policy
Further information pertaining PTT Outdoor Adventures’ treatment of personally identifiable information is available for perusing on PTT Outdoor Adventures’ current Privacy Policy, which is hereby incorporated by reference; your acceptance of this Agreement constitutes your acceptance and agreement to be bound by PTT Outdoor Adventures’ Privacy Policy.
4. Registration & Policy
In order to make full use of the Services, you may be required to register with PTT Outdoor Adventures, by means of creating an account; username (“PTT Outdoor Adventures User ID”) and selecting a password. In the event that you access the Services via a third-party site or service, PTT Outdoor Adventures may bid you to use the username on such third-party site or service as the PTT Outdoor Adventures User ID. If you so choose to register for the Service, you agree to provide and maintain true, accurate, complete and updated registration information as prompted by the Service’s registration form. You shall also be held responsible for maintaining the confidentiality of your password. PTT Outdoor Adventures reserves the right to cancel or refuse any registrations in its discretion. Failure to abide by the terms would constitute a breach of this Agreement and may result in the expeditious termination of your account.
5. Miscellaneous
Failure to comply and exercise, in any respect, the rights provided for herein shall not be deemed an exemption of any further rights as provided by this Agreement. PTT Outdoor Adventures shall not be held accountable for any causes beyond PTT Outdoor Adventures’ reasonable control, including but not limited to, electronic or mechanical failure or degradation. This includes failure to perform its obligations or Services due to complications out of PTT Outdoor Adventures’ control.
In the case where any provisions of this Agreement is unenforceable and inapplicable, it shall be eliminated to the extent necessary for it to remain in full effect and applicable once more. This Agreement is by no way assignable, sublicensable and transferable by you without PTT Outdoor Adventures’ prior written consent. However, PTT Outdoor Adventures hold the right to do as such with the Agreement and its rights and obligations without consent from any party.
By using the Services, both parties agree that the Agreement is veritable, absolute and thorough; an exclusive statement dictating mutual understanding of the parties and supersedes all previous oral or written consensus, communications and compact relating to the Agreement. All modifications must be in written form, signed by both parties except as otherwise provided herein
You do not have any authority of any kind to bind PTT Outdoor Adventures in any respect whatsoever and this Agreement does not, in any sense, constitute a joint venture, employment, collaborative agency or partnership in any manner.
6. Arbitration; Governing Law
This Agreement is bounded and construed in accordance with the laws as dictated by the authoritative bodies of Malaysia.
